MEMBERSHIP TERMS & CONDITIONS | DISCLAIMER

 1. MEMBERSHIP BENEFITS

The Elite Cosmetique Membership Program entitles Members to the following benefits:

Exclusive Membership Pricing with approved and active Elite Cosmetique Provider (“Elite Cosmetique Providers”), as published by Elite Cosmetique and online at www.MyECLife.com

2. CERTAIN CONDITIONS

(a)     For any Member’s discount or other benefit to apply, the Membership account must be active and available at the point of service or purchase.  Members will NOT be reimbursed by the Elite Cosmetique Provider retroactively for purchases made or services rendered without an active Membership at the time of purchase or provision of service.

(b)     Member’s pricing is only valid on eligible purchases or services with Elite Cosmetique Providers.

(c)     Member’s pricing and discounts cannot be used in conjunction with any coupons, or prearranged discounts, unless specifically stated. Price guarantees are in place to ensure lowest cost offerings by 5% for services and procedures at a given location.

(d)     Memberships are for individual use only and are non-transferable.

(e)     Members must submit and maintain accurate and current user information in connection with their Memberships. Such information includes, without limitation, name, address, email address, and telephone number. Periodically we may utilize systems to update the mailing address of Membership accounts, through information provided by the United States Postal Service. Members can change their account information by (i) calling Member Services at 888-567-ELITE, (ii) e-mail – as specified on the contact information page at www.MyECLife.com, or (iii) by mail – as specified on the contact information page at www.MyECLife.com. We cannot assume any liability for correspondence, mail or e-mail, that is lost, delayed, or misdirected. It is the Member’s responsibility to ensure that Elite Cosmetique has the Member’s accurate and current user information.  

 

3. MEMBERSHIP FEES

(a) The enrollment fees and monthly dues for Platinum and Gold Memberships are subject to change without notice in the sole discretion of Elite Cosmetique.  The current fees are as follows:

Platinum Membership:

$299.99 enrollment due at signup, $49.99 monthly, $49.99 annual renewal

Gold Membership:

$149.99 enrollment due at signup, $24.99 monthly, $49.99 annual renewal

 

(b) Membership fees are subject to taxation in accordance with applicable federal or state law. These fees do not include applicable taxes. Fees are not refundable unless the Membership is canceled during the first thirty (30) days of the Membership term, and prior to obtaining any products or services from any Elite Cosmetique Provider.

 

(c) Membership upgrade and downgrade is allowable at any time. You can do this by contacting Member Services at 888.567.ELITE (Toll Free), or through an email sent to membersupport@MyECLife.com. Fee schedule for upgrading or downgrading is as follows:

 

                Upgrade:  $150 enrollment

                Downgrade: $10 administration fee

 

NOTE: You will not be refunded the difference in enrollment fees when downgrading from Platinum to a Gold Membership, nor will you be reimbursed on a pro rata basis for any monthly dues previously paid in the month of downgrade. Additionally, you may not downgrade within six (6) months of upgrading to a Platinum Membership.

4. TERM; BILLING

The initial term of a Membership shall commence on the date it is purchased and continue in active status, as automatic monthly billings are timely and fully made.

Membership fees will be billed to the credit card we currently have on file, in accordance with the following schedule:

·         Enrollment Fee: Billed immediately upon Membership purchase.

·         Monthly Fees: Billed automatically beginning approximately one month  from the purchase date of the Membership.

·         Annual Renewal Fee: Billed automatically, on or around the first day of the month in which your anniversary date occurs on an annual basis.

 

5. CANCELLATION; TERMINATION 

(a) ELITE COSMETIQUE, LLC 100% SATISFACTION GUARANTEE

At Elite Cosmetique it is our goal to provide our Members with superior benefits and service. If you are not 100% satisfied, for any reason, please contact an Elite Cosmetique Member Services Representative at 888.567.ELITE (toll free) and we promise to courteously and promptly address your concerns. If you are still not 100% satisfied, we will promptly refund your Membership fees as provided below.

Guarantee Terms:

To obtain a Membership fee refund, you must contact one of our Member Services Representatives at 888.567.ELITE (toll free) within thirty (30) days of the commencement of your Membership and prior to obtaining any products or services from any Elite Cosmetique contracted Provider.  A signed statement, along with Membership Card, must be turned into Elite Cosmetique by mail in order to complete membership cancellation.

 

(b) For terminations occurring after thirty (30) days from the commencement of your Membership or after your obtaining any products or services from an Elite Cosmetique Provider, you have the right to cancel your Membership at any time on thirty (30) days written notice to Elite Cosmetique.  Please note you will not be entitled for any refund of unused Membership fees paid for terminations occurring after thirty (30) days from the commencement of your Membership or after your obtaining any products or services form an Elite Cosmetique Provider. 

 

(c) Elite Cosmetique may terminate your Membership, including any associated accounts, without notice, for any reason in our sole discretion, including without limitation our belief that continued use of such Membership would violate any provisions of the Membership Agreement, applicable law, or otherwise be harmful to our interests. In the event of such termination, you will be entitled to a pro rata refund of your Membership fees.

 

(d) Elite Cosmetique may, in its sole discretion, change, replace, modify or discontinue any of the Membership benefits, products or services available under the Elite Cosmetique Membership Program at any time with or without prior notice.

 

6. MEMBER PRIVACY POLICY

As a Member, the information we capture will be subject to the Elite Cosmetique Privacy Policy as amended from time to time in accordance with its terms. You may view the current version of the Elite Cosmetique Privacy Policy at any time online at www.MyECLife.com.

 

7.   NO WARRANTIES; LIMITATION OF LIABILITY

ELITE COSMETIQUE MAKES NO WARRANTIES OF ANY KIND OR NATURE, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE, OR WARRANTIES OF ANY PRODUCTS OR SERVICES PROVIDED BY A ELITE COSMETIQUE PROVIDER VENDOR.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF ELITE COSMETIQUE, REGARDLESS OF WHETHER SUCH LIABILITY IS BASED ON BREACH OF CONTRACT, TORT, STRICT LIABILITY, BREACH OF WARRANTIES, FAILURE OF ESSENTIAL PURPOSE OR OTHERWISE SHALL BE LIMITED TO THE TOTAL MEMBERSHIP FEES PAID BY YOU TO ELITE COSMETIQUE.  IN NO EVENT WILL ELITE COSMETIQUE BE LIABLE FOR CONSEQUENTIAL, INCIDENTAL, INDIRECT, PUNITIVE OR SPECIAL DAMAGES (INCLUDING LOSS OF PROFITS, DATA, BUSINESS OR GOODWILL), REGARDLESS OF WHETHER SUCH LIABILITY IS BASED ON BREACH OF CONTRACT, TORT, STRICT LIABILITY, BREACH OF WARRANTIES, FAILURE OF ESSENTIAL PURPOSE OR OTHERWISE, AND EVEN IF ADVISED OF THE LIKELIHOOD OF SUCH DAMAGES.  MEMBER’S RECOURSE WITH RESPECT TO ANY LIABILITY OR OBLIGATION OF ELITE COSMETIQUE HEREUNDER SHALL BE LIMITED TO THE ASSETS OF ELITE COSMETIQUE, AND MEMBER SHALL HAVE NO RECOURSE AGAINST, AND SHALL BRING NO CLAIM AGAINST, ANY OWNER, OFFICER, EMPLOYEE OR AGENT OF ELITE COSMETIQUE OR ANY OF THE ASSETS THEREOF.

 

USE OF ELITE COSMETIQUE MEMBERSHIPS AND ANY OF ITS ASSOCIATED BENEFITS IS AT YOUR SOLE RISK.  THE MEMBERSHIP BENEFITS ARE PROVIDED ON AN “AS IS”, “WHERE IS” AND “AS AVAILABLE” BASIS.

 

ELITE COSMETIQUE MAKES NO GUARANTY OR WARRANTY THAT (i) THE ELITE COSMETIQUE MEMBERSHIP PROGRAM WILL MEET YOUR INDIVIDUAL NEEDS OR REQUIREMENTS, (ii) ELITE COSMETIQUE MEMBERSHIPS WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR (iii) THE QUALITY OF ANY PRODUCTS, SERVICES, PROCEDURES, INFORMATION, OR OTHER SERVICES OR PRODUCTS PURCHASED OR OBTAINED BY YOU FROM THE USE OF ELITE COSMETIQUE MEMBERSHIPS WILL MEET YOUR EXPECTATIONS.

 

THE DISCOUNT MEDICAL PLANS OF ELITE COSMETIQUE OFFER A REDUCTION IN THE COST OF COSMETIC PROCEDURES AND AESTHETIC MEDICINE. ELITE COSMETIQUE DISCOUNT BENEFIT PROGRAMS ARE NOT INSURANCE, NOR ARE THEY AN ALTERNATIVE TO OR SUBSTITUTION FOR INSURANCE. SINCE THEY ARE NOT HEALTH INSURANCE, MEMBERS MUST USE ELITE COSMETIQUE PROVIDERS, AND MEMBERS ARE RESPONSIBLE FOR PAYMENT TO ELITE COSMETIQUE PROVIDERS AT POINT OF SERVICE WHEN DISCOUNT FEES ARE INCURRED. DISCOUNTS ARE RETAIL ONLY. DISCOUNTS MAY NOT BE USED WITH OTHER COUPONS OR SPECIALS.
